Quick answer: a Spanish citizen can apply for Paraguay residency under the general immigration framework. The ordinary route begins with temporary residence for up to two years, while specific routes can lead directly to permanent residence. But Paraguayan residence, an ID card or even a RUC does not automatically end Spanish tax residence. If tax relocation is the objective, the move has to be coordinated across both countries.
Paraguay has become increasingly visible to Spanish entrepreneurs, professionals and investors. Paraguay Migration granted 1,023 residencies to Spanish citizens in 2025, up from 466 in 2024, and Spain remained among the leading nationalities during 2026.
For a Spanish citizen, there are really two separate projects:
- obtaining legal residence in Paraguay;
- building, where relevant, a defensible change of tax residence away from Spain.
Confusing the two is one of the biggest strategic mistakes in a Spain–Paraguay move.
Why are more Spanish citizens considering Paraguay?
Accessible residence, competitive costs, territorial taxation and investment possibilities have made Paraguay increasingly relevant to Spanish founders, professionals and investors.
That does not mean Paraguay is suitable for everyone.

first determine what you are trying to achieve and what must be resolved correctly in Spain; then decide whether Paraguay fits.
For someone who simply wants an alternative residence or a South American base, the analysis is mainly immigration and operational.
For someone seeking to cease Spanish tax residence, the standard must be considerably higher.
Which type of Paraguay residence can a Spanish citizen obtain?
Ordinary route: temporary residence
Temporary residence under Law No. 6984/2022 can be granted for up to two years and extended for an equal period.
During processing, the applicant obtains precarious-resident status, which permits exit and re-entry, study and work while the temporary application is pending.
Temporary residents can subsequently obtain a Paraguayan ID card with matching validity.
As a general rule, temporary residence is the prerequisite for permanent residence.

Direct permanent-residence routes
Not every foreign national must pass through temporary status.
Specific categories can qualify for direct permanent residence, including certain family categories and qualifying investors.
Since 2026, the Paraguay Investor Pass has included productive, financial, real-estate and tourism investment routes with different requirements.
The right route should be selected by objective, not simply by speed.
Current temporary-residence requirements for Spanish citizens
The current general list published by Paraguay Migration includes:
- valid Spanish identity document or passport;
- evidence of regular entry into Paraguay;
- apostilled birth certificate;
- apostilled civil-status certificate where applicable;
- applicable police/criminal record certificate based on country of origin or recent residence;
- INTERPOL background certificate;
- Paraguayan foreigner-background certificate;
- sworn declaration to comply with Paraguay’s Constitution and laws;
- sworn declaration of profession, activity or occupation and Paraguayan address.
Foreign documents must comply with apostille/legalisation and Spanish-translation requirements where applicable.
Two important corrections to older online guides
The current general temporary-residence list does not include a medical certificate as a general requirement.
Nor does it impose one generic financial-solvency requirement for the ordinary temporary-residence application. Solvency becomes particularly relevant later when changing to permanent residence and in specific immigration routes.
Practical process: what to prepare in Spain and what to do in Paraguay
1. Define the strategy first
Before ordering apostilles, decide whether the objective is:
- ordinary temporary residence;
- direct permanent residence;
- a Plan B;
- a genuine relocation;
- a Spanish tax exit;
- investment or a business structure.
2. Obtain Spanish documents
Birth, civil-status and criminal-record documents should be obtained in forms suitable for international use and apostilled where required.
3. Check validity before travelling
Some administrative documents have validity windows. Ordering everything too early can create unnecessary repeat work.
4. Enter Paraguay lawfully
Retain the relevant entry evidence or passport stamp.
5. Complete local documents
INTERPOL, foreigner-background checks, authentication and sworn declarations form part of the local process.
6. File the residence application personally
Paraguay Migration states that the temporary-residence filing is personal and in person. Subsequent follow-up can be handled personally or through a legal representative.
7. Apply for the Paraguayan ID card
Once the relevant residence has been granted, the ID card is processed through Identification authorities.
8. Open a RUC only if there is a tax reason
A RUC is not automatically required merely because you become resident.
It should be opened when a real tax activity or obligation justifies it.

Paraguay tax residence for Spanish citizens: the second half of the move
Legal permission to live in Paraguay and a Paraguayan tax-residence position are different questions.
The DNIT has a specific process for issuing a Tax Residence Certificate.
For an individual, the procedure requires, among other elements, a Paraguayan ID and migration-movement evidence for the period being certified.
There is no universal rule in that procedure saying “X days automatically equals Paraguay tax residence”.

When can Spain still treat you as Spanish tax resident?
Spanish law does not ask only whether you hold foreign residence documents.
More than 183 days in Spain
An individual can be Spanish tax resident when spending more than 183 days during the calendar year in Spanish territory.
Sporadic absences can be included unless foreign tax residence is proven under the applicable rules.
Main centre or base of economic activities or interests
Spanish residence can also arise where the main centre or base of the person’s activities or economic interests is located in Spain, directly or indirectly.
Spouse and dependent minor children
There is also a rebuttable presumption where the non-separated spouse and dependent minor children habitually reside in Spain.
Spending fewer than 183 days in Spain is therefore not a complete tax-exit strategy by itself.
What if both Spain and Paraguay treat you as resident?
The Spain–Paraguay Double Tax Treaty is now especially important.
If both countries regard an individual as resident under their domestic laws, Article 4 applies the following sequence:
- permanent home;
- centre of vital interests;
- habitual abode;
- nationality;
- mutual agreement if still unresolved.
The treaty creates considerably more certainty than existed before it became effective, but it does not turn a Paraguayan residence permit into an automatic Spanish tax exit.
Spanish Form 030: reporting the change does not create the change
Spain’s Tax Agency uses Form 030 for individuals to communicate, among other changes, tax residence and tax domicile.
When reporting a change of tax residence abroad, the AEAT states that supporting documentation includes:
- Spanish ID/NIE documentation;
- a tax-residence certificate issued by the tax authority corresponding to the foreign address.
But filing Form 030 does not convert facts that still point to Spanish residence into non-residence.
Tax residence is determined by law and facts.
The AEAT also treats tax residence by complete calendar years, and the effective year of non-residence can depend on when the habitual move occurs and how many days were spent in Spain.
At N30 Paraguay, we do not treat Form 030 as the start of the strategy. It is one documentary consequence of a move that should already be supported by the underlying facts.
Which Spanish ties should be reviewed before moving?
The answer depends on the person, but common areas include:
- home available in Spain;
- spouse and minor children;
- professional activity;
- Spanish customers;
- Spanish SL companies;
- director or management roles;
- where business decisions are actually taken;
- Spanish real estate;
- banking and investments;
- significant company shareholdings;
- pensions;
- Spanish-source taxes that will remain after non-residence.
A valid tax exit does not necessarily require eliminating every Spanish connection.
It requires knowing which connections can remain, how they will be taxed and which ones can contradict the tax position you intend to defend.
Can Spanish exit tax apply when moving to Paraguay?
Yes, for certain taxpayers holding significant company shares.
Article 95 bis of Spain’s Personal Income Tax Law can deem a capital gain to arise on change of tax residence where its statutory conditions are met.
Among other requirements, it can affect someone who has been an IRPF taxpayer for at least 10 of the previous 15 tax periods and where:
- the combined market value of qualifying shares exceeds EUR 4 million; or
- if that threshold is not met, the person owns more than 25% of an entity and the market value of that holding exceeds EUR 1 million.
This is particularly relevant to founders and business owners.
It does not mean every Spanish SL shareholder has exit tax, but the issue should be checked before the move is executed.
What if you keep property in Spain?
Ceasing Spanish tax residence does not mean Spain stops taxing all Spanish-source income.
Spanish real estate remains within the Spanish non-resident tax framework.
Depending on use, this can include:
- imputed income on certain urban property;
- rental income;
- capital gains on sale.
The Spain–Paraguay treaty also allows the country where the property is situated to tax real-estate income and qualifying gains.
What if you keep a Spanish SL company?
Owning shares in a Spanish SL does not automatically make the shareholder Spanish tax resident.
But a company adds questions such as:
- Do you remain a director?
- Where is the company actually managed?
- What remuneration do you receive?
- Do you receive dividends?
- Where is the business activity performed?
- Could there be a permanent-establishment or effective-management issue?
The Spain–Paraguay treaty uses place of effective management to resolve certain corporate dual-residence situations.
Moving personally to Asunción does not automatically move a Spanish company with you.
How does Paraguay actually tax income after the move?
Paraguay uses territorial taxation, but that does not mean “anything foreign is tax-free”.
The key question is whether the income is considered Paraguayan-source.
This matters especially for consultants, freelancers, agencies, digital businesses and founders physically working from Paraguay for foreign customers.
A customer located in Spain does not automatically make a service performed from Paraguay foreign-source income.
What evidence can support a defensible move?
There is no magic checklist that guarantees a result.
A coherent position may include:
- migration records;
- genuine housing in Paraguay;
- Paraguayan residence and ID;
- Tax Residence Certificate where appropriate;
- contracts and activity genuinely performed from Paraguay;
- tax registrations and filings consistent with that activity;
- banking and financial flows that can be explained;
- Spanish census/tax-residence updates;
- correct treatment of companies and property retained in Spain.
In Spain–Paraguay cases, getting the card is rarely the hardest part. The harder task is making sure the movements, home, activity, companies, family and tax treatment all tell the same story.
